European Commission investigates Slovak toll road tender

The European Commission (EC) suspects that the Slovakia National Highway Company (NDS) acted unlawfully when it excluded applicants that submitted cheaper bids than the winner from the tender for the country’s first electronic toll road. The Slovak Government has received a letter to this effect from Charlie McCreevy, the EU Commissioner for the Internal Market. Both the National Highway Company and the Transport Ministry believe that the tender was carried out in line with valid legislation.

SkyToll, a joint-stock company established by members of the Ibertax-SanToll consortium and backed by the French highway company Sanef, secured the most expensive commission in the history of the country, despite submitting the most expensive bid. The losing bidders were: a consortium led by the Austrian company Kapsch TrafficCom; the Slovak-Swiss consortium ToSy.sk, headed by Elektrovod Holding; and Slovakpass, led by the Italian company Autostrade, which offered the lowest price.

Brussels has begun proceedings against Slovakia over the tender, demanding that the Government provide an explanation and hand over all the documentation. The Slovak authorities now have two months to react. “We've registered another demand by the EC for an explanation of certain issues concerning the tender. Just as we have already done twice before, we'll submit all the relevant information about this, we're not making any secret out of it,” says NDS general director, Igor Choma, adding that NDS will respect any decision made by the EC.
